DMCA Policy

This DMCA Policy explains how STEMBridge Stats ("we", "us", or "our") responds to claims of copyright infringement under the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. § 512. If you believe that material available on our website at stembridgestats.com infringes your copyright, please follow the procedure described below. We take intellectual property rights seriously and will respond to valid notices promptly.

1. What the DMCA Is

The Digital Millennium Copyright Act is a United States copyright law that provides a framework for online service providers to respond to allegations of copyright infringement. Under the DMCA's "safe harbour" provisions, a website operator can limit its liability for infringing content hosted or transmitted through its service, provided it follows a defined notice-and-takedown process. This policy sets out that process for STEMBridge Stats.

STEMBridge Stats is an educational statistics platform for secondary school students. Our content consists primarily of original calculators, step-by-step worked examples, and curriculum-aligned explanations written in-house. We do not knowingly host third-party copyrighted content without authorisation.

2. How to Submit a Takedown Notice

If you are a copyright owner, or are authorised to act on behalf of one, and you believe that content on STEMBridge Stats reproduces your copyrighted work without permission, you may submit a written DMCA takedown notice. Your notice must include all of the following elements required by 17 U.S.C. § 512(c)(3):

  • Identification of the copyrighted work — A description of the work you claim has been infringed, or, if multiple works on a single site are covered by a single notice, a representative list of those works.
  • Identification of the infringing material — A description of the material you claim is infringing and that you want removed, along with information reasonably sufficient to permit us to locate the material on our website. Providing the specific URL or URLs is the clearest way to do this.
  • Your contact information — Your full legal name, mailing address, telephone number, and a valid email address at which we can reach you.
  • A statement of good faith belief — A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  • A statement of accuracy — A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on behalf of the copyright owner.
  • Your physical or electronic signature — A physical or electronic signature of the person authorised to act on behalf of the owner of the copyright interest.

Notices that omit any of these required elements may not be acted upon. Please send your completed notice through our Contact page with the subject line "DMCA Takedown Notice". We will acknowledge receipt and aim to investigate within 14 business days.

3. What Happens After We Receive a Notice

Upon receiving a valid and complete DMCA takedown notice, we will:

  • Review the notice to confirm it contains all required elements under 17 U.S.C. § 512(c)(3).
  • Make a good faith assessment of whether the identified material is likely to infringe the stated copyright.
  • Remove or disable access to the allegedly infringing material expeditiously if the notice appears valid.
  • Notify the person who posted the content (if applicable and identifiable) that the material has been removed.

Submitting a takedown notice does not automatically result in removal. We reserve the right to assess each notice individually and to decline to remove content where we reasonably determine that it does not infringe or qualifies as fair use, commentary, criticism, education, or another permitted use under applicable law.

4. Counter-Notice Procedure

If content you posted to STEMBridge Stats has been removed following a DMCA takedown notice, and you believe the removal was made in error or as a result of misidentification, you may submit a written counter-notice under 17 U.S.C. § 512(g)(3).

A valid counter-notice must contain the following:

  • Identification of the removed material — A description of the material that was removed and its location on our website before removal (the URL, if known).
  • A statement under penalty of perjury — A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your contact information — Your full legal name, mailing address, and telephone number.
  • Consent to jurisdiction — A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, for any judicial district in which STEMBridge Stats may be found), and that you will accept service of process from the person who filed the original takedown notice.
  • Your physical or electronic signature.

If we receive a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10 to 14 business days that they have filed a court action to restrain the activity, we may restore the removed material at our discretion.

5. Repeat Infringer Policy

In appropriate circumstances, and in our sole discretion, we will terminate the access of users who are found to be repeat infringers. This policy applies to any person who submits content to the platform — for example, through our contact or feedback forms — and who is subject to more than one valid, uncontested DMCA takedown notice.

Because STEMBridge Stats does not operate a user-generated content platform where members upload files or posts, this situation is unlikely to arise. Nonetheless, we maintain this policy as required for DMCA safe harbour eligibility under 17 U.S.C. § 512(i).

6. Fair Use and Educational Use

Some content that might superficially resemble copyrighted material is not infringing. Relevant doctrines include fair use (17 U.S.C. § 107), which permits limited use of copyrighted material for purposes such as criticism, commentary, teaching, scholarship, and research, and the idea-expression dichotomy, which means that copyright protects specific creative expression but not the underlying mathematical facts, formulas, methods, or concepts.

STEMBridge Stats is an educational platform. Standard mathematical formulas — such as the formula for standard deviation, or the steps for constructing a frequency distribution — are in the public domain and cannot be owned by any party. Our calculators, worked-example layouts, and explanatory text are original works created for this platform. Where we reference published syllabi or examination board content, we do so in accordance with fair dealing and educational use principles.

If you are unsure whether a particular use qualifies as fair use or educational use, we encourage you to consult a qualified legal adviser before submitting a takedown notice. Submitting a false or knowingly inaccurate takedown notice may expose the sender to liability for damages, including costs and legal fees, under 17 U.S.C. § 512(f).

7. Misrepresentation

The DMCA provides at 17 U.S.C. § 512(f) that any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages — including any costs and legal fees incurred by the alleged infringer, the copyright owner, or the service provider who acted on the notice.

We will not act on notices we have reason to believe are submitted in bad faith, and we reserve the right to seek appropriate relief where necessary.

8. Designated Agent

We have not registered a formal DMCA Designated Agent with the U.S. Copyright Office at this time, as STEMBridge Stats is a small educational platform with no user-generated content functionality. All DMCA-related correspondence should be directed to us through our Contact page with the subject line "DMCA Takedown Notice" or "DMCA Counter-Notice" as appropriate.

If we register a Designated Agent in the future, this page will be updated to reflect the registered agent's name and contact information.

9. Modification of This Policy

We may update this DMCA Policy from time to time to reflect changes in our practices, legal obligations, or the structure of the platform. Any updates will be reflected in the "Last updated" date at the top of this page. Your continued use of STEMBridge Stats after an updated policy is posted constitutes your acceptance of the revised terms.

This policy should be read alongside our Privacy Policy, which explains how we handle personal information submitted as part of a takedown or counter-notice.
